1. Who we are

Instra-Swap ("the Service") is provided by Daniel Zhang, an individual ("we", "us"). When you use the Service you are entering into an agreement with Daniel Zhang.

2. Acceptance

By accessing or continuing to use the Service you agree to these Terms. If you do not agree, do not use the Service.

3. The Service

Instra-Swap reads sheet music you upload (files, screenshots or photos) using AI, and rewrites it for a different instrument, including transposition, clef, key signature and tablature. A free preview of the first measures is available; the full transcription of a piece is sold per page.

4. Eligibility

You must be of legal age in your country to make purchases, or have permission from a parent or guardian. If you use the Service for an organisation, you confirm you are authorised to bind it.

5. Acceptable use

You must not misuse the Service, including:

• using it for anything unlawful, fraudulent, or for spam;
• uploading material that infringes anyone's copyright or other intellectual property rights;
• uploading illegal, hateful or harmful content, or content unrelated to music intended to abuse the AI;
• interfering with the Service's security, including malware, probing, scraping, or attempts to bypass payment or usage limits (including "jailbreaking" the AI);
• reverse engineering, reselling or redistributing the Service.

6. Your uploads and outputs

You are responsible for the sheet music you upload and must have the right to use it (for example, it is your own work, in the public domain, or you own a copy for personal performance). You are responsible for how you use the transcriptions you receive. You grant us a limited licence to process your uploads solely to provide the Service. As between you and us, you keep whatever rights you have in your uploads, and the output is provided for your use subject to the rights of the original work's owner.

Rights holders who believe content processed by the Service infringes their rights can contact us and we will review and remove it where appropriate. Users who repeatedly infringe will have their access suspended.

7. AI accuracy

Transcriptions are generated by AI and may contain mistakes (for example wrong notes, rhythms or accidentals). Always check the output before performing or publishing it. We may filter or refuse outputs and remove content that breaks these Terms.

8. Intellectual property

We own the Service and its software, design, documentation and branding. We grant you a limited, non-exclusive, non-transferable right to use it in line with these Terms.

9. Payments

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax and refund terms are set out in Paddle's Buyer Terms. See also our Refund Policy.

10. Service level

We work to keep the Service running well, but we do not guarantee it will be uninterrupted or error-free. To the fullest extent permitted by law, the Service is provided "as is" without implied warranties.

11. Liability

To the extent permitted by law, we are not liable for indirect or consequential losses, and our total liability is limited to the amount you paid us in the 12 months before the claim. Nothing limits liability that cannot be limited by law (such as for fraud, death or personal injury).

12. Suspension and termination

We may suspend or end your access if you materially breach these Terms, fail to pay, create a security or fraud risk, or repeatedly or seriously break our policies.

13. Changes and governing law

We may update these Terms from time to time; continued use means you accept the updated Terms. These Terms are governed by the laws of the place where Daniel Zhang resides.
